Who bears the burden of replacing dedicated server hardware?

One of the key selling points about dedicated and managed dedicated hosting is the client doesn't have to worry about keeping spare parts or maintaining the equipment.

Now imagine a client getting an impersonal email like the one received from a well known, public corporation for a dedicated server that was supposed to be under their care:

    "We have received notification from the Compaq Insight Manager System that your server is about to fail. This is based on Mean Time Before Failure (MTBF) analysis on all Compaq hardware. I need to speak with someone about this as soon as possible to explore options in upgrading this server."

The technologists will state that servers have a typical life span of three to five years. The customers shouldn't have to care. And yet most providers will not deal with this issue in their contracts, and how they work with their customers.

When the company above was asked:

    "Does our contract state your company is not responsible for making repairs to the server after 3 years or any other specified period of time?"

One of the original founders replied, "It is silent altogether on hardware." And their solution for the customer was for the customer to bear the burden of a new set up fee, and increased monthly fees along with data migration to move to the new equipment.

No set up fee will be charged, and Dynamic Net will provide up to five hours of data migration professional services to migrate your existing data to the new equipment.

This means that Dynamic Net will take the responsibility of replacing equipment used in a customer's solution every three years with little to no financial impact to the customer.
